- Contest Dates. Contest begins at 12:00:00 a.m. (PST) on May 9, 2007 and ends at 11:59:59 p.m. (PST) on December 31, 2009.
- Eligibility. Only residents of the 50 United States of America or the District of Columbia who are between 13 and 18 years old (an "Eligible Teen") are eligible to win the Contest.
- How To Enter. Nominator may nominate an Eligible Teen by submitting (a) one photo of the nominee and (b) a brief written statement about why the nominee is making a difference in the world and deserves to be a PBteen "Teen of the Month." The written statement must also include the following information: (1) nominator's age, name, address and telephone number and (2) nominee's age, name, address, and telephone number. Nominator can submit the photo and written statement by mail at PBteen Teen of the Month," 3250 Van Ness Avenue, San Francisco, CA 94109 or online at pbteen.com/stylehouse.
- License. Nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) must read and agree to the following terms: By submitting the photo and written statement ("Submitted Materials"), nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) hereby irrevocably grants to Sponsor and its affiliates, and their respective successors and assigns, a non-exclusive, fully-paid, royalty-free, worldwide, perpetual license, including the unlimited right to sublicense, to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit and distribute the Submitted Materials in any medium now known or later developed. Sponsor has no obligation whatsoever to use the Submitted Materials or notify nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) before it uses the Submitted Materials. Nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) represents and warrants that: (a) nominator or nominator's parent or legal guardian is the sole author/creator of the Submitted Materials and the Submitted Materials are original and not copied in whole or in part from any other work; and (b) the Submitted Materials do not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or entity. Nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) also irrevocably grants to Sponsor and its affiliates, and their respective successors and assigns, permission to use nominator's name, age, likeness and image, and all other information about nominator, provided by nominator, for advertising and promotional purposes without additional compensation of any kind to nominator or nominator's parent or legal guardian, except where prohibited by law.
- Winner Selection; Judging Criteria. Sponsor will select one (1) winner every month from among all eligible entries received based on the following criteria: quality of community activities or involvement (50%) and overall enthusiasm and attitude (50%). The judging criteria are to be applied in the sole discretion of Sponsor, and the individual judges, based solely on the Submitted Materials. By entering the Contest, nominator acknowledges that such evaluations may differ from person to person and agrees to be bound by and not challenge the final decisions of Sponsor and the individual judges. All non-winning eligible entries will be considered in subsequent monthly selections.
- Prize. Each monthly winner will be profiled in the PBteen StyleHouse at the PBteen Web site (www.pbteen.com/stylehouse) and will receive a $100 PBteen gift card and $100 markmakers.org gift card. Gift cards subject to standard terms and conditions. The Prize cannot be redeemed for cash and may not be substituted or transferred. Approximate retail value of all prizes: $6,400 ($200 for each monthly winner).
- Odds. The odds of winning depend upon the number of eligible entries received. Sponsor cannot accurately predict the number of contestants who will participate in the Contest.
- Sponsor is not responsible for telecommunications, network, electronic, technical or computer failures of any kind, including any which may affect entry or the Contest. Sponsor is not responsible for lost, stolen, misdirected, mutilated, late or illegible entries. Entries not in compliance with these Official Rules are disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter.
- By entering the Contest, you agree to release, discharge, indemnify and hold harmless Sponsor and its parents, subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from all claims, liabilities and obligations of any kind or nature whatsoever arising from or relating to the Contest, including without limitation, personal injury, death, property damage, or claims based on intellectual property rights, publicity rights, privacy rights, defamation, or Sponsor's use of any Submitted Materials.
- Employees and agents, including their family (parents, children, siblings, spouse) and members of their household (whether or not related), of Sponsor and its subsidiaries, affiliates, parent companies, distributors, divisions, agencies or of any related entity, including any consultants to Sponsor, are not eligible to participate in the Contest.
- Additional Documents. Nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) and winners' parents or legal guardians may be required to sign, notarize and return to Sponsor an Affidavit of Eligibility, a Publicity Release, and assignment documents respecting Submitted Materials. If nominator (or, if nominator is under 18 years old, nominator's parent or legal guardian) or winner's parents or legal guardians fail to sign all additional documents requested by Sponsor, the prize may be forfeited and awarded to an alternate winner. Winner (or, if winner is under 18 years old, winner's parent or legal guardian) will be required to sign, notarize and return an Affidavit of Eligibility and a Prize and/or Publicity Release. There is typically a fee for the services of a Notary Public, which can be found at most bank locations, as well as other locations.
- Attempts to notify winners will be made by mail or telephone within thirty (30) days of Sponsor selecting the winner. Sponsor is not responsible for lost, stolen, late or misdirected mail or communication problems of any kind. If unable to make contact with any winner within thirty (30) days after Sponsor first attempts to notify the winner, or if any winner fails to claim the prize within thirty (30) days after Sponsor first attempts to notify the winner, the prize may be forfeited and awarded to an alternate winner. All prizes will be awarded.
- WINNERS ARE RESPONSIBLE FOR REPORTING AND PAYING ANY AND ALL INCOME, SALES OR EXCISE TAXES THAT MAY APPLY; SPONSOR IS NOT LIABLE FOR AND WILL NOT PAY ANY SUCH TAXES.
- BECAUSE SPONSOR COLLECTS PERSONAL INFORMATION FROM PARTICIPANTS ENTERING THE CONTEST, SPONSOR ENCOURAGES ALL PARTICIPANTS TO REVIEW ITS PRIVACY POLICY, WHICH CAN BE REVIEWED AT WWW.PBTEEN.COM.
- Sponsor reserves the right to suspend or cancel the Contest or modify these Official Rules as necessary for any reason or as required by applicable law. Sponsor reserves the right, at its sole discretion, to disqualify from the Contest, and ban from any future Contest, any person it believes to have intentionally violated these Official Rules or tampered with any element of the Contest without notice to the disqualified and/or banned person.
- The Contest shall be governed by the laws of the State of California, without giving effect to any choice of law or conflict of laws rules or provisions. By participating in the Contest, you agree that California courts shall have jurisdiction over any dispute or litigation arising from or relating to the Contest and that venue shall be only in San Francisco, California.
